These Terms of Use (hereinafter the “Terms of Use”) are entered into between, on the one hand, Algis Fargo, sole trader, SIREN (French business identification number) 948 125 711, operating under the trade name Algis Fargo (hereinafter “the Publisher”), and, on the other hand, any person who has visited the sitehttps://getgalaxybrain.com and/or signed up to the GalaxyBrain waitlist, hereinafter referred to as “the User”.
Any visit to the site https://getgalaxybrain.com (hereinafter the “Site”) or any sign-up to the waitlist automatically entails acceptance of all of these terms.
Preliminary article
- Beta: free, restricted-access test version of GalaxyBrain, a desktop artificial intelligence tool, to which the Publisher may invite Registrants.
- Registrant: any User who has registered their email address on the Waitlist.
- Waitlist: list of the email addresses of Users who wish to be informed about GalaxyBrain and invited to the Beta.
- User: any person who accesses the Site, whether or not they are a Registrant.
- Site: https://getgalaxybrain.com and all related pages.
Article 1 – Purpose and scope of the Terms of Use
The purpose of these Terms of Use is to define the conditions under which Users may access the Site, use it and sign up to the Waitlist.
The parties are bound by all of the terms, conditions and policies described herein.
Any visit to the Site or sign-up to the Waitlist implies unreserved acceptance of these Terms of Use.
Article 2 – Version of the Terms of Use in force
The version of the Terms of Use that prevails is the latest version available on the Site.
The Publisher reserves the right to update, change or replace any part of these Terms of Use at any time and without notice.
Acceptance of the version in force applies at each visit and at each sign-up.

Article 3 – Conditions of use of the Site
The Site is hosted by Cloudflare, Inc. (Cloudflare Pages) (unless the host changes).
By accepting these Terms of Use, the User expressly declares that they have reached the legal age of majority.
The User undertakes not to use the Site for illegal purposes or to compromise its operation.
The Publisher reserves the right to interrupt all or part of the Site’s service at any time, without notice.
Article 4 – General conditions
The Publisher reserves the right to refuse access to the Site or to the services to anyone, at any time, for any reason whatsoever.
Signing up to the Waitlist does not guarantee an invitation to the Beta. The Publisher may limit invitations to the Beta by geographical area, per Registrant or in number.
Article 5 – Free of charge
Access to the Site, sign-up to the Waitlist and the Beta are free of charge. Nothing is sold on the Site and no payment is requested.
Article 6 – Presentation of GalaxyBrain
The visuals, animations and demonstrations on the Site are not contractually binding and depend on the technical constraints of the devices used.
The Publisher does not guarantee the absolute accuracy of the visuals, colours or details presented.
Article 7 – Optional tools
The Publisher may provide access to third-party tools, to be used at the User’s discretion and risk.
Article 8 – Third-party links
The Site may contain links to third-party sites.
The Publisher is not responsible for the content of, or transactions carried out on, these third-party sites.
Article 9 – User comments, suggestions and other submissions
Any content submitted to the Publisher, including answers to the optional questionnaire offered after sign-up, may be used freely by the Publisher, without any obligation of confidentiality or compensation.
Article 10 – Personal information
The submission of personal information is governed by the Publisher’s Privacy Policy, available here: https://getgalaxybrain.com/privacy/.
Article 11 – Accuracy of sign-up information
The User undertakes to provide an accurate and up-to-date email address when signing up.
The Publisher may refuse or delete any sign-up deemed suspicious.
Article 12 – Prohibited uses
It is prohibited to use the Site for illegal or fraudulent purposes, or to disrupt its operation or the privacy of others.
Article 13 – Sign-up
The User may sign up to the Waitlist without having to create an account: only an email address is requested.
A confirmation is displayed on the Site as soon as the sign-up is recorded. An optional questionnaire may then be offered.
Article 14 – No returns and no refunds
The Beta is free of charge and no purchase is made on the Site: consequently there are no returns, exchanges or refunds. If a paid offer is made available later, its terms will be published before any purchase.

Article 15 – Limitation of liability and legal guarantees
The Publisher shall not be held liable for any indirect damage, unlawful use of the Site, service interruption, force majeure or any event beyond its control.
As no sale is concluded on the Site, the legal guarantee of conformity, the guarantee against hidden defects and the 14-day right of withdrawal, which attach to sales, do not apply to these Terms of Use. They will apply to any later paid offer, under the conditions and subject to the exceptions provided by law.
Article 16 – Indemnification
The User undertakes to indemnify the Publisher for any damage caused by a breach of the Terms of Use or of the law.
Article 17 – Severability
If any provision of the Terms of Use is held invalid, the other provisions remain in force.
Article 18 – Termination
The obligations of the parties arising before termination survive.
The Terms of Use remain effective until terminated by either party.
Article 19 – No waiver
The Publisher’s failure to enforce a right does not constitute a waiver of that right.
Article 20 – Governing law
These Terms of Use are governed by French law.
