Algis Fargo, a sole trader operating under the trade name Algis Fargo (hereinafter “we”), operates the sitehttps://getgalaxybrain.com, including all related information, content, features and tools, in order to present GalaxyBrain to you, a desktop artificial intelligence tool currently in a free private beta, and to let you sign up to its waitlist (hereinafter the “Services”). Nothing is sold on the site. The site is hosted by Cloudflare (Cloudflare Pages), which enables us to provide the Services to you. This Privacy Policy describes how we collect, use and disclose your personal information when you access or use the Services, sign up to the waitlist, answer the optional questionnaire, or otherwise communicate with us. It covers the site and the waitlist; it does not cover the GalaxyBrain application itself. In the event of a conflict between our Terms of Use and this Privacy Policy, this Privacy Policy prevails with regard to the collection, processing and disclosure of your personal information.

Please read this Privacy Policy carefully. By accessing and using our Services, you acknowledge that you have read this Privacy Policy and understand the collection, use and disclosure of your information as described in it.

Personal information we collect or process

When we use the term “personal information”, we mean information that identifies you or that can reasonably be linked to you or to another person. Personal information does not include information collected anonymously or de-identified so that it cannot identify you or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

  • Contact details: your email address, which you enter to join the waitlist. No name, phone number or postal address is requested.
  • Referral information: when the link that brought you to the site contains the optional “v” parameter, its value (which indicates the video or campaign that brought you to the site) is recorded with your sign-up.
  • Questionnaire answers: after you sign up, an optional questionnaire is offered to you (the difficulty you face, the solutions you use today, frequency, motivation, and any free text you choose to write). All answers are optional. To link them to your sign-up without sending your email address again, a random identifier is created at sign-up; it only allows answers to be sent for one day.
  • Your communications with us, including the information you include in your messages, for example when you email us.
  • Device information, including information about your device, browser or network connection, your IP address and other unique identifiers, in particular during the form’s anti-bot check.
  • Usage information, including information about your interaction with the Services, in particular how and when you access or interact with the Services: pages viewed, clicks, heatmaps, performance measurements and session recording, when audience measurement is enabled. The email address displayed on screen is excluded from session recording.

No payment information is collected and no account is created.

Sources of personal information

We may collect personal information from the following sources:

  • Directly from you, including when you sign up to the waitlist, answer the questionnaire, access or use the Services, communicate with us, or otherwise provide us with your personal information;
  • Automatically through the Services, including from your device when you visit the site, and through the use of cookies and similar technologies. In particular, your browser’s local storage keeps the origin of your first visit (the “v” parameter, landing page and the site you came from);
  • From our service providers, including when we engage them to enable certain technologies and when they collect or process your personal information on our behalf.

How we use your personal information

Depending on how you interact with us or which Services you use, we may use your personal information for the following purposes:

  • Managing the waitlist and inviting you to the beta. We use your email address to record your sign-up, invite you to the GalaxyBrain private beta and keep you informed about it. We use the referral information to know which video or campaign brought you to the site.
  • Understanding your needs and improving the Services. We use your questionnaire answers to understand the needs of people interested in GalaxyBrain and to tailor the Services more relevantly.
  • Security and fraud prevention. We use your personal information to protect the sign-up form against bots, to detect, investigate or act on fraudulent, illegal, dangerous or malicious activity, to protect public safety and to secure our services.
  • Audience measurement. When audience measurement is enabled, we use usage information to understand how the site is viewed and to improve it.
  • Communicating with you. We use your personal information to respond to your requests and provide you with effective services.
  • Legal reasons. We use your personal information to comply with applicable law or respond to valid legal proceedings, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or ongoing litigation or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.

How we disclose personal information

In certain circumstances, we may disclose your personal information to third parties for legitimate reasons, in accordance with this Privacy Policy. These circumstances may include:

  • With providers who perform services on our behalf: Cloudflare (site hosting, storage of the waitlist and questionnaire answers in its D1 database, Turnstile anti-bot check) and PostHog (audience measurement, on its infrastructure located in the European Union).
  • In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligation (including in response to subpoenas, search warrants or similar requests), to enforce applicable terms or policies, and to protect or defend the Services, our rights and the rights of our users or third parties.

Relationship with Cloudflare and PostHog

The Services are hosted by Cloudflare, which collects and processes personal information about your access to and use of the Services in order to provide the Services to you. When you submit the sign-up form, the Cloudflare Turnstile service analyses technical signals from your browser and your IP address to check that the request does not come from a bot. Your email address, the referral information and any questionnaire answers are stored in the Cloudflare D1 database. When audience measurement is enabled, usage information is sent to PostHog. The information you submit to the Services may be transmitted to these providers, which may be located in countries other than the one where you live, in order to provide and improve the Services. Third-party websites and links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites that are not affiliated with or controlled by us, we recommend that you review their privacy and security policies and their other terms and conditions. We do not guarantee and are not responsible for the privacy or security of these sites, including the accuracy, completeness or reliability of the information found on them. Information you provide in public or semi-public spaces, including information you share on third-party social media platforms, may also be visible to other users of the Services and/or to users of those third-party platforms, without restriction on its use by us or by a third party. Our inclusion of such links does not in itself imply any endorsement of the content of those platforms or of their owners or operators, unless stated otherwise on the Services.

Children’s data

The Services are not intended for use by children, and we do not knowingly collect any personal information about children who have not reached the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details below to request its deletion. As of the effective date of this Privacy Policy, we have no knowledge that we “share” or “sell” (as those terms are defined by applicable law) personal information about individuals under 16 years of age.

Security and retention of your information

Please note that no security measure is perfect or impenetrable and that we cannot guarantee “perfect security”. In addition, any information you send us may not be secure in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on various factors, such as whether we need the information to manage the waitlist, provide you with the Services, comply with our legal obligations, resolve disputes or enforce any other applicable contract or policy. In particular:

Your rights and choices

Depending on where you live, you may have some or all of the rights listed below regarding your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in some cases, we may decline your request as permitted by law.

  • Right of access / right to know. You may have the right to request access to the personal information we hold about you.
  • Right to erasure. You may have the right to request that we delete the personal information we hold about you.
  • Right to rectification. You may have the right to request that we correct inaccurate personal information we hold about you.
  • Right to portability. You may have the right to receive a copy of the personal information we hold about you and to request that it be transferred to a third party, in certain circumstances and with certain exceptions.
  • Managing communication preferences. You may at any time ask to stop receiving our messages and to be removed from the waitlist by writing to us at [email protected].

If you live in the United Kingdom or the European Economic Area, and subject to the exceptions and limitations provided by local law, you may exercise the following rights in addition to the rights listed above:

  • Objection to processing and restriction of processing: you may have the right to ask us to stop or restrict the processing of your personal information for certain purposes.
  • Withdrawal of consent: where we rely on your consent to process your personal information, you have the right to withdraw that consent. If you withdraw your consent, this does not affect the lawfulness of processing based on your consent before its withdrawal.

We will not penalise you for exercising any of these rights. We may need to verify your identity before we can process your requests, as required or permitted by applicable law. In accordance with applicable law, you may designate an authorised agent to make requests to exercise your rights on your behalf. Before accepting such a request from an agent, we will require the agent to provide proof of the authorisation you gave them to act on your behalf, and we may ask you to verify your identity directly with us. We will respond to your request within the time limits set by applicable law.

Please note that we may transfer, store and process your personal information outside the country in which you live.

If we transfer your personal information outside the European Economic Area or the United Kingdom, we will rely on recognised transfer mechanisms, such as the European Commission’s standard contractual clauses, or where applicable any equivalent contract issued by the competent UK authority, unless the data transfer is made to a country recognised as providing an adequate level of protection.

Changes to this Privacy Policy

We may update this Privacy Policy at any time, in particular to reflect changes to our practices or for other operational, legal or regulatory reasons. We will publish the revised Privacy Policy on this website, update the “Last updated” date and provide notice in accordance with applicable law.
